Patents

Since Lithuania is a contracting party to the Patent Cooperation Treaty and the European Patent Convention protection of an invention may be obtained through the following routes:

1. national patenting procedure;
2. PCT procedure;
3. validation/extension of European patents.

When choosing among these procedures it might be helpful to know that the Lithuanian SPB examiners do not conduct searches and examination against the criteria of novelty.

Non-patentable inventions include inter alia:

methods for treatment of the human or animal body by surgery or therapy, and diagnostic and prophylactic methods practised on the human or animal body, unless the object of the invention is equipment or materials utilised for such methods;
plant or animal varieties or essentially biological processes for the production of plants or animals;
inventions the commercial exploitation of which would be contrary to public interests, principles of morality and humanity.
processes for cloning human beings;
processes for modifying the germ line genetic identity of human beings;
uses of human embryos for industrial or commercial purposes;
processes for modifying the genetic identity of animals which are likely to cause them suffering without any substantial medical benefit to man or animal, and also animals resulting from such processes.

A foreign applicant being not resident of the European Community and seeking to patent his invention in Lithuania has to appoint a local agent to act before the local Patent Office.

Disputes that may arise between the applicant and the SPB examiners are subject to consideration by the SPB Appeal Board. All other disputes initiated by third persons are subject to court consideration.
