Genericism
A local dairy SIAULIU PIENAS applied for registration of the mark RAMBYNAS for
cheese. The examiner allowed the mark for registration. Another local dairy
- Zemaitijos Pienas - opposed to registration of the mark. The opponent insisted
that the word stands for a type of cheese produced by a number of Lithuanian
cheese manufacturers for over 40 years. The opponent produced evidences in support
of the claim, namely publications about the history of Rambynas cheese production
as well as the description of the technology of production in professional literature.
The Board upheld the opposition and the word RAMBYNAS was left free for all
cheese producers.
