The Madrid Protocol
Lithuania has been a member to the Madrid Protocol since 1997. Many foreign
applicants enjoy the advantages of this system to obtain protection in Lithuania.
Our SPB examination criteria are exactly the same as those applied to national
registrations. There is some difference in the time schedule of the procedure.
While in the national procedure the examiner's decision precedes the opposition
period, in case of International marks the opposition period (3 months after
the date of publication of registration or the date of publication of subsequent
designation) expires much earlier than the period established for examination
(18 months from the date of notification about registration or the date of
notification of subsequent designation).
Like in case with national applications, Lithuanian examiners do not check
International marks against prior applications or registrations.
Provided there arise no obstacles in obtaining territorial extension to Lithuania
the assistance of a local attorney is not necessary. However in case of examiner's
objections and refusal to grant protection or oppositions, the applicant having
no residence in the European Community will have to appoint a local agent
to communicate with the local SPB and represent him in the opposition procedure.
